1. Acceptance of Terms

By accessing or using SmartCandidate ("the Platform"), operated by Editoby Ventures, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform.

2. Platform Description

SmartCandidate is a political campaign management platform providing tools for voter outreach, social media management, field operations coordination, and campaign analytics for political candidates and their campaign teams in Nigeria.

3. Permitted Use

You may use SmartCandidate for lawful political campaign activities in compliance with:

• The Nigerian Electoral Act 2022
• INEC guidelines on political advertising and campaign financing
• Meta's Political Advertising Policy
• Twitter/X Political Advertising Policy
• Nigeria Communications Commission regulations on bulk messaging

4. Prohibited Activities

You must not use SmartCandidate to:

• Send unsolicited messages to individuals who have not consented to receive campaign communications
• Publish false or misleading information about political candidates
• Interfere with, disrupt, or undermine the electoral process
• Violate any applicable law, regulation, or third-party rights
• Attempt to gain unauthorised access to other users' data or accounts
• Use the platform for any purpose other than legitimate political campaign activities

5. Voter Data Responsibility

You are solely responsible for ensuring that voter contact data you upload to the Platform was obtained lawfully and that you have appropriate authority to use it for political outreach. Editoby Ventures accepts no liability for unlawful collection or use of voter data by campaign clients.

6. Social Media Compliance

When using SmartCandidate to publish content on Facebook, Instagram, or Twitter/X, you are responsible for ensuring all content complies with those platforms' political advertising policies, including required disclosures and pre-registration requirements where applicable.

7. Service Availability

We strive to maintain platform availability but do not guarantee uninterrupted service. We are not liable for any losses arising from platform downtime, particularly during election periods. We recommend testing all campaign functions well in advance of critical campaign dates.

8. Intellectual Property

SmartCandidate, its design, code, and underlying technology are the intellectual property of Editoby Ventures. Campaign data, voter databases, and content you create remain your property. You grant us a limited licence to process this data solely for the purpose of providing the Platform services.

9. Limitation of Liability

To the maximum extent permitted by Nigerian law, Editoby Ventures shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of SmartCandidate. Our total liability for any claim arising from these terms shall not exceed the amount you paid us in the three months preceding the claim.

10. Termination

We reserve the right to suspend or terminate your access to SmartCandidate at any time if you violate these Terms, applicable law, or the terms of any integrated third-party service. Upon termination, your data will be retained for 30 days before deletion.

11. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes arising from these Terms shall be resolved in the courts of Lagos State, Nigeria.
